Terms of Service

Welcome to We Fast Together ("WFT", "we", "us", or "our"). By accessing or using our mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

I. MEDICAL DISCLAIMER

WFT is NOT a medical device and does not provide medical advice. The content provided is for informational and community purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or experienced on WFT. If you think you may have a medical emergency, call your doctor or emergency services immediately.

II. ELIGIBILITY

The Service is rated 18+ on the App Store. You must be at least 18 years old to create an account and use the Service independently. Users under 18 may only use the Service with verifiable parental or legal guardian consent. By using WFT, you represent and warrant that you are at least 18 years of age, or that your parent or legal guardian has reviewed and agreed to these Terms on your behalf and consents to your use of the Service.

III. ACCOUNTS & SECURITY

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating your account.
  • Notify us immediately of any unauthorized use of your account.
  • Not share your account credentials with any third party.
  • Not create multiple accounts for deceptive purposes.

We reserve the right to suspend or terminate accounts that violate these Terms.

IV. YOUR HEALTH & SAFETY

Fasting involves dietary changes that can significantly affect your health. You acknowledge and agree that:

  • Your use of the Service is entirely at your own risk.
  • WFT is not responsible for any health problems that may result from fasting programs, information, or community interactions you encounter through the Service.
  • You should consult a qualified healthcare professional before beginning any fasting regimen, especially if you have pre-existing health conditions, are pregnant or nursing, or take medication.
  • You will discontinue fasting and seek medical attention if you experience adverse health effects.

V. SUBSCRIPTIONS & PAYMENTS

Certain features of the Service are available only with a paid subscription ("Premium").

  • Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually) through the Apple App Store.
  • Free Trials: If offered, free trial periods convert to paid subscriptions automatically unless canceled before the trial ends.
  • Renewal: Your subscription will automatically renew at the end of each billing cycle unless canceled at least 24 hours before the expiry date.
  • Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period. You will retain access to Premium features until that date.
  • Price Changes: We may change subscription pricing from time to time. Any price changes will take effect at the start of your next billing cycle after notice.
  • Refunds: All fees are non-refundable except as required by applicable law or Apple's refund policies.

California Auto-Renewal Disclosure (Cal. Bus. & Prof. Code § 17600 et seq.)

Your subscription will automatically renew at the then-current price using the payment method on file with Apple unless you cancel at least 24 hours before the end of the current period. You may cancel at any time in your Apple ID account settings. No refunds will be provided for partial billing periods.

VI. USER CONDUCT

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Harass, abuse, threaten, or harm another person.
  • Post content that is hateful, discriminatory, obscene, or promotes violence.
  • Impersonate any person or entity, or falsely claim an affiliation.
  • Interfere with or disrupt the Service, servers, or connected networks.
  • Submit false reports or abuse the reporting system.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Use the Service for any commercial purpose without our prior written consent.
  • Promote eating disorders, dangerous fasting practices, or medically unsound advice.

VII. COMMUNITY STANDARDS & MODERATION

We promote a positive and supportive fasting environment. Our community features (Chat, Team Events) are subject to moderation.

  • Zero Tolerance: We have a zero-tolerance policy for harassment, hate speech, bullying, or inappropriate content.
  • Community & Self Moderation: Our platform is community-moderated. We provide tools for you to report offensive messages and block abusive users directly within the app. You are responsible for curating your own experience by using these tools.
  • No Liability for User Content: WFT is a platform for user-generated content. We do not pre-screen all content and are not responsible or liable for any content posted by users. User posts do not represent the views or opinions of WFT.
  • Moderation Rights: While we have no obligation to monitor all content, we reserve the right to remove any content and suspend or ban any user who violates these rules, at our sole discretion and without prior notice.

VIII. INTELLECTUAL PROPERTY

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of WFT and its licensors. The Service is protected by copyright, trademark, and other laws.

Your Content: By posting, submitting, or displaying content on or through the Service (including chat messages, reactions, and other community contributions), you grant WFT a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely in connection with operating and improving the Service. You retain ownership of your content.

You represent and warrant that you own or have the necessary rights to the content you post, and that such content does not infringe the rights of any third party.

IX. TERMINATION

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service will immediately cease.
  • We may delete your account data in accordance with our Privacy Policy.
  • Sections that by their nature should survive termination will survive (including Arbitration, Limitation of Liability, Indemnification, and IP provisions).

You may delete your account at any time through the app Settings. Account deletion is permanent and cannot be undone.

X. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WFT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service;
  • Unauthorized access, use, or alteration of your transmissions or content;
  • Any health outcomes related to your use of fasting information obtained through the Service.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

XI. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless WFT and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service;
  • Your violation of these Terms;
  • Your violation of any rights of another person or entity;
  • Any content you post or submit through the Service.

XII. DISPUTE RESOLUTION & BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Agreement to Arbitrate: You and WFT agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration, rather than in court, except that either party may seek equitable relief in court for infringement or misuse of intellectual property rights.

Class Action Waiver: YOU AND WFT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Arbitration Rules: Arbitration shall be administered by JAMS under its Streamlined Arbitration Rules and Procedures, or by another mutually agreed-upon arbitration provider. The arbitration shall take place in Los Angeles County, California, or at another mutually agreed-upon location.

30-Day Opt-Out: You may opt out of this arbitration provision by sending written notice to legal@wefasttogether.com within 30 days of first accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of arbitration.

XIII. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

XIV. INTERNATIONAL USERS

The Service is operated from the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws. If any provision of these Terms conflicts with the mandatory consumer protection laws of your jurisdiction, those local laws shall prevail to the extent of the conflict.

XV. FORCE MAJEURE

WFT shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, power failures, internet or telecommunications failures, or third-party service disruptions.

XVI. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date and, where practicable, by providing notice through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.

XVII. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

XVIII. ASSIGNMENT

You may not assign or transfer these Terms or your rights under them without our prior written consent. WFT may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

XIX. NO THIRD-PARTY BENEFICIARIES

These Terms are for the benefit of you and WFT only. No third party shall have any right to enforce any provision of these Terms, except as expressly provided herein.

XX. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Health Data Policy, constitute the entire agreement between you and WFT regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

XXI. CALIFORNIA CONSUMER NOTICE

Under California Civil Code Section 1789.3, California consumers are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
